These Terms & Conditions (“Terms”) apply to your use of viaahmubarak.com (the “Site”), operated from [Ludhiana], Punjab, India, by [Jaswinder Singh, sole proprietor, trading as Viaah Mubarak (“we”, “us”, “our”). By registering on or using the Site you agree to these Terms, our Privacy Policy and our Refund Policy. If you do not agree, please do not use the Site.
1. Who can use the Site
You must be an adult who is of legal age to marry under Indian law (currently 18 years for a woman and 21 years for a man), and legally free to marry. You may create a profile only for yourself, or for your son, daughter, brother or sister with their knowledge and permission. We may ask you to confirm this.
2. Your account and profile
- Everything you tell us must be true, complete and up to date, including your name, age, marital status, education, profession and photographs.
- Do not create a profile for anyone without their permission, and do not use another person’s name or photograph.
- Keep your password private. You are responsible for activity on your account.
- Every new profile is reviewed by us before it goes live. We may accept, reject, edit or remove a profile at our discretion, for example if information appears false or misleading.
3. What you must not do
- Give false or misleading information, or hide that you are married.
- Harass, threaten, abuse or pressure any member, or send spam, advertisements or unwanted messages.
- Ask for money, gifts, loans or investments, or use the Site for any purpose other than a genuine search for a marriage partner.
- Copy, collect, share, sell or publish another member’s details or photographs, or use them for any commercial purpose.
- Use bots, scrapers or other automated tools, or try to break into or disrupt the Site.
- Upload anything unlawful, obscene or offensive, or anything that belongs to someone else.
We may suspend or remove an account that breaks these rules, without refund.
4. Your content
You keep ownership of the information and photographs you provide. By adding them you give us permission to store them and to show them to other members as described in our Privacy Policy and as set by your privacy settings. You may ask us to delete your account at any time.
5. Visibility of your profile
Registered members who are logged in can see the basic details listed in our Privacy Policy. Your mobile number, email address, photographs and other private details are hidden by default and can be seen only by you and our administrators. Members on a paid plan may be able to unlock some of these details for a profile, as set out below. By registering you agree to this.
6. Paid plans
We offer the following paid plans. Prices are in Indian Rupees and include applicable taxes:
- Silver: Rs 491, 5 unlocks, valid for 15 days.
- Gold: Rs 950, 10 unlocks, valid for 30 days.
- Standard Platinum: Rs 1,400, 15 unlocks, valid for 45 days.
- Royal Platinum NRI: Rs 3,200, 30 unlocks, valid for 90 days.
The features of each plan are shown on our Membership page at the time of purchase. We may change plan features and prices for future purchases. The terms in force at the time of your purchase apply to your plan.
7. Unlocks
- One unlock lets you view the private contact details of one member profile. Depending on your plan, this may include mobile number, email address, photographs and parents’ contact details.
- Only profiles that we have marked as ID Verified can be unlocked.
- Unlocks can be used only while your plan is valid. Unused unlocks expire when the plan ends. They cannot be carried forward, transferred, sold or shared.
- A profile you have unlocked stays visible to you until your plan expires.
- You must use unlocked details only for a genuine marriage proposal and must keep them private.
8. ID Verified
A profile is marked ID Verified after we have checked an identity document that the member shared with us. This means only that we have checked that document. We do not verify every statement a member makes, and we do not guarantee any member’s identity beyond that check, conduct, intentions, education, income, family or background. Please do your own checks and take care before you meet or share money or personal information with anyone.
9. Relationship manager and matchmaking services
Services included in some plans, such as a relationship manager and priority NRI matchmaking, are provided within reasonable limits set by us. We do not promise a match, a reply or a marriage.
10. Payments and refunds
All payments for paid plans are final and non-refundable, except in the cases listed in our Refund Policy. Please read it before you pay. Payments are processed by our payment provider, and we do not store your card or bank details.
11. Suspension and ending your account
You can ask us to delete your account at any time. We may suspend or end your access if you break these Terms, if we believe your profile is false or harmful, or if the law requires it. If we do so for a breach of these Terms, no refund is given.
12. Disclaimer
The Site and our services are provided “as is”. We are a platform that helps people meet, and we are not a party to any relationship, meeting or marriage that follows. We do not promise that the Site will always be available or free of errors.
13. Limit of our responsibility
To the extent the law allows, we are not responsible for any loss or harm arising from your dealings with other members, from information provided by members, or from your use of the Site. Our total responsibility to you for any claim is limited to the amount you paid us for your current plan.
14. Reporting a profile
If you see a fake, offensive or misleading profile, write to help@viaahmubarak.com with the profile name and the reason. We review every report.
15. Changes to these Terms
We may update these Terms from time to time. The latest version, with its date, is always on this page. If you keep using the Site after a change, you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of India. Courts at [Ludhiana], Punjab have jurisdiction over any dispute, subject to the law.
